By accessing, using, or making a booking through this website, email, social media, or any affiliated platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. These Terms are governed by applicable laws of the Republic of the Philippines and are drafted in accordance with generally accepted international commercial practices. The Terms and Conditions have been last updated on April 16, 2026

1. Company Information

SYKE Travel & Tours and SMAK’s Hotel & Restobar operate from:
Saagundo Street, Poblacion, Santa Fe, Cebu 6047, Philippines

2. Booking & Contract Formation

All bookings made through this website, email, social media, partner platforms, or any other communication channel are subject to availability and final confirmation by SYKE Travel & Tours.

A binding contract shall only be formed once the required payment, whether full or partial as applicable, has been successfully received and a booking confirmation or voucher has been issued by SYKE Travel & Tours.

We reserve the right to refuse, decline, or cancel any booking in cases including but not limited to force majeure, pricing or system errors, supplier limitations, operational constraints, or regulatory restrictions. In such cases, any refund shall be subject to the applicable cancellation, refund, and payment policies.

3. Agency Role & Third-Party Services

SYKE Travel & Tours acts solely as an intermediary, coordinator, and booking agent for transportation services, tours, accommodations, and flights that may be provided by independent third-party operators or suppliers.

SYKE Travel & Tours does not own, operate, manage, or control vehicles, vessels, aircraft, hotels, or other service infrastructure used in the delivery of such third-party services, unless expressly stated otherwise.

All transportation, tour, and flight services arranged through SYKE Travel & Tours are carried out by independent service providers operating under their own terms, operational policies, licenses, insurance arrangements, and applicable laws and regulations.

Payments received by SYKE Travel & Tours may include both the cost of the third-party service and a service fee, coordination fee, or commission retained by SYKE Travel & Tours for arranging and facilitating the booking.

By booking through SYKE Travel & Tours, the client acknowledges and agrees that the actual provision and execution of third-party services are the sole responsibility of the respective third-party provider.

4. Payment Policy

Credit / Debit Card Payments

Payments made via credit or debit card are processed through secure third-party payment providers. Once payment is successfully completed, the booking may be confirmed subject to availability and final verification.

For multi-destination, seasonal, or dynamically priced packages, final pricing may vary by up to 10% due to supplier adjustments, fuel surcharges, route changes, or similar operational factors. Any material adjustment will be disclosed and, where applicable, approved prior to final voucher issuance.

Cash, Bank Transfer & e-Wallet Payments

Reservations remain tentative until the required prepayment has been successfully received and acknowledged.

Minimum prepayment: 50% of the total booking value, unless otherwise stated.

The final balance for multi-day tours, packages, or accommodation bookings is due no later than 7 days before arrival or departure, unless a different deadline has been agreed in writing.

Accepted payment methods may include bank transfer, certified remittance centers, GCash, Maya, cash payments, or approved online payment links.

5. Cancellation & Refund Policy

Day Tours & Transfers
Full refund if cancelled at least 48 hours prior to departure.

Hotels & Accommodations
Cancellations made at least 48 hours before arrival may be eligible for up to a maximum 50% refund. Reservation fees, administrative fees, and non-recoverable supplier charges are non-refundable.

Multi-Day Tours

  • 70% refund if cancelled 60 days or more before departure
  • 50% refund if cancelled 14–59 days before departure
  • 0% refund if cancelled 0–13 days before departure

Flights between Cebu and Bantayan Island are strictly non-refundable, regardless of reason, unless otherwise required by applicable law.

Refunds are subject to applicable transaction fees, payment gateway charges, remittance costs, foreign exchange losses, administrative costs, and other non-recoverable processing fees, all of which shall be borne by the client unless otherwise required by law.

In cases of weather disruption, force majeure, safety concerns, supplier cancellation, or other events beyond reasonable control, refunds, credits, rebooking options, or alternatives shall be determined fairly in accordance with applicable law, supplier policies, and the recoverability of amounts already paid to third-party providers.

6. Consumer Protection & Fair Dealing

SYKE Travel & Tours aims to conduct business fairly, transparently, and in good faith, and complies with applicable consumer protection requirements of the Republic of the Philippines, including the Consumer Act of the Philippines (RA 7394), where applicable.

Clients are entitled to accurate information, transparent pricing, and fair treatment. Any complaint or dispute shall be addressed in good faith, with the objective of reaching an amicable resolution whenever reasonably possible.

7. Intellectual Property

All content on this website, including but not limited to text, images, graphics, logos, branding elements, videos, downloadable materials, and other media, is the intellectual property of SYKE Travel & Tours, SMAK’s Hotel & Restobar, or their respective licensors.

Any unauthorized reproduction, copying, modification, resale, republication, or redistribution of such content, whether in whole or in part, is strictly prohibited without prior written consent.

8. User Content & Comments

Where permitted, users may submit comments, reviews, feedback, or other content through the website or affiliated platforms.

By submitting such content, you grant SYKE Travel & Tours a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, and distribute such content for lawful business and promotional purposes.

We reserve the right, but not the obligation, to remove or decline any content deemed unlawful, defamatory, offensive, misleading, abusive, infringing, fraudulent, or otherwise inappropriate.

9. Limitation of Liability

To the fullest extent permitted by applicable law, SYKE Travel & Tours shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with:

  • the acts, omissions, negligence, delays, defaults, cancellations, or service failures of third-party operators or suppliers;
  • accidents, injuries, death, loss, theft, or damage to persons or property occurring during or in connection with the provision of third-party services;
  • force majeure events, including but not limited to adverse weather, natural disasters, government actions, strikes, transport disruptions, port closures, safety restrictions, fuel shortages, or operational interruptions;
  • errors, interruptions, or temporary unavailability of the website, booking systems, payment platforms, or communication channels.

As an intermediary and booking agent, SYKE Travel & Tours does not assume liability for the actual operation, execution, or performance of services rendered by independent third-party providers. Any claims relating to the execution of such services must, to the extent permitted by law, be directed to the relevant provider.

Where liability of SYKE Travel & Tours cannot be excluded under applicable law, such liability shall, to the maximum extent permitted by law, be limited to the amount actually paid by the client to SYKE Travel & Tours for the specific service giving rise to the claim.

Nothing in these Terms shall exclude or limit liability for fraud, willful misconduct, gross negligence where such exclusion is prohibited by law, or any other liability that cannot lawfully be excluded or restricted under applicable law.

10. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without prejudice to any mandatory consumer protection rights that may apply under applicable law.

Any dispute, claim, or controversy arising out of or in connection with these Terms and Conditions or any booking shall be submitted to the exclusive jurisdiction of the competent courts of Cebu City, Philippines, unless otherwise required by mandatory law.
